Welcome to Food KAB! These Terms of Service ("Terms") govern your use of the Food KAB platform, including our website, mobile applications, and related services (collectively, the "Services") operated by The Food KAB LLC ("Food KAB," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

2. Description of Services

Food KAB provides a local food delivery platform connecting customers with restaurants and delivery drivers in the Springtown, Azle, TX and surrounding communities. Our Services include:

• Online food ordering and delivery
• Restaurant partner portal for order management
• Driver application for delivery fulfillment
• KAB Plus membership program
• Pick & Drop courier services

3. User Accounts

To use certain features of our Services, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

4. Ordering and Payment

Orders: When you place an order through Food KAB, you are making an offer to purchase from the restaurant. The restaurant may accept or decline your order.

Pricing: Menu prices are set by restaurants and may differ from in-store prices. Delivery fees, service fees, and taxes are displayed before checkout.

Payment: We accept credit/debit cards and other payment methods as displayed. All payments are processed securely through our payment partners.

Refunds: Refund requests are handled on a case-by-case basis. Contact us if there's an issue with your order.

5. KAB Plus Membership

KAB Plus is our optional membership program offering benefits such as reduced fees and exclusive deals. Membership terms:

• Monthly subscription billed automatically
• Cancel anytime with no penalty
• Benefits apply only to eligible orders

6. Restaurant Partners

Restaurants using our platform agree to:

• Maintain accurate menu information and pricing
• Prepare orders in a timely manner
• Comply with all food safety regulations
• Treat customers and drivers with respect

7. Delivery Drivers

Drivers using our platform agree to:

• Complete deliveries safely and professionally
• Maintain valid driver's license and insurance
• Handle food with care and hygiene
• Communicate promptly about delivery status

8. Prohibited Conduct

You agree not to:

• Use our Services for any illegal purpose
• Harass, abuse, or harm others
• Provide false information
• Interfere with the operation of our Services
• Attempt to gain unauthorized access to our systems
• Use automated systems to access our Services without permission

9. Intellectual Property

The Food KAB name, logo, and all related content are owned by The Food KAB LLC. You may not use our trademarks without written permission. User-generated content remains yours, but you grant us license to use it in connection with our Services.

10. Disclaimers

Our Services are provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of restaurant information
• Specific delivery times
• Quality of food from restaurant partners

11. Limitation of Liability

To the maximum extent permitted by law, Food KAB shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services. Our total liability shall not exceed the amount you paid to us in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless Food KAB and its officers, directors, employees, and agents from any claims arising from your use of our Services or violation of these Terms.

13. Changes to Terms

We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting us.

15. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Parker County, Texas.
